Personal data

What personal data do we collect and with whom do we share your personal information?

We do not collect or sell personal information to external partners. We may share your information with partners, but only in order to provide you with a service to which you have subscribed, to fill in a form with the information required to draw up a quote or to improve your user experience on the site. We never pass on your personal information to third parties for their own marketing purposes.

We may ask you to provide us with personal information in order to provide you with the service you expect. For example, we may ask you for your contact details so that we can send you our newsletter or so that you can create an account to access reserved areas of the site. We may also ask you to enter your payment details so that you can pay for your purchases via a secure external site, and also offer to save them to make future orders easier.

The personal data we ask you to provide, and the reason we ask for it, are clearly indicated at the points where we collect your information (e.g. contact form).

We may share your information with the following recipients:

* Support Companies who provide us with the main data processing services, such as ensuring the security of our site, and who process data for the purposes described above, or who were introduced to you when we collected your data. For example, if you wish to register to receive e-mail updates, the only data collected will be your name, e-mail address and the page on which you filled in a form. This information is stored directly on MailerLite servers.

* Trusted Third-Party Companies that provide additional data processing services, analyze data (Google Analytics, Tag Manager, Microsoft Clarity), provide marketing services and manage credit card processing (Paypal). These third parties have only limited access to the data they need to perform their services, and may not use it for any other purpose. In addition, they are contractually obliged to use the data in accordance with this privacy policy and in compliance with applicable data protection legislation.

* Legal or similar bodies, where we believe that the transmission of information is necessary (i) in the event of a legal obligation or (ii) to establish and defend our legitimate rights, and

* Any other person designated by you, with your explicit consent.

Legal basis for processing personal data

The legal basis for collecting and using personal data as described above depends on the type of information and the context in which it is collected.

We collect your personal data in the following cases:

* The information is necessary to provide a service (for example, we need your e-mail address to send you a newsletter, and your postal address to deliver your order);

* The processing we carry out is necessary to defend one of our legitimate interests, without overriding your own rights.

* You have explicitly consented to this (for example, you have ticked a box authorizing us to send you advertising for products or services from partners, which we think may be of interest to you); or

* The information is necessary to fulfil our legal obligations (e.g. tax obligations).

* You have submitted an unsolicited application. In this case, you authorize Atomic Mouse to forward your data (e.g. CV, personal details) to relevant companies.

Each of our messages includes an unsubscribe link that you can use to unsubscribe at any time.

When we collect and use your personal data on the basis of our legitimate interest, it will be to enable us to provide or improve our services, sites and communications, namely prospecting and direct marketing actions, fraud prevention, management of customer and prospect questions... We may have to rely on the basis of legitimate interest for other processing and, where appropriate, we will tell you at the necessary time what these legitimate interests are.

How do we guarantee the protection of your Personal Data?

We have taken appropriate organizational and technical measures to protect the data we collect and process. These measures are designed to provide the level of security required to meet the risks associated with the processing of your data. Where we need to share data with third-party companies, we ensure that the data will also be protected, and will not be provided or resold to an unauthorized third party.

All personal data are processed in accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”).

International data transfers

Your personal information may be transferred to and processed in countries other than the country in which you are resident. These countries may have data protection laws that differ from those in your country (and, in some cases, may not be as protective). In particular, some of the recipients of the personal data we collect are located outside the European Union, notably in the United States. The United States does not currently have a uniform data protection law, but our provider has implemented technology and security policies and procedures that ensure a level of data protection equal to that in place under European directives.

Data retention

We retain the personal information we collect from you where we have a legitimate business interest in doing so (for example, to provide you with a service you have requested) or to comply with legal, tax or accounting requirements. When we no longer have a legitimate interest to justify processing your personal information, we will delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in a backup archive), we will store your data securely.

Your rights to data protection

You have the following rights with regard to the protection of personal data:

* If you wish to access, correct, update or request the deletion of your personal information, you can do so at any time by writing at this contact e-mail address. We may not be entitled to delete your personal information if we need to retain it in order to comply with our legal obligations, to perform a public interest task, to establish, exercise or defend any legal claim or to exercise our right to freedom of expression and information.

* In addition, you may object to the processing of your personal information, ask us to limit the processing of your personal information or request the portability of your personal information. Again, you can exercise these rights by contacting us here.

* You have the right to opt-out of marketing communications from us at any time. You can exercise this right by clicking on the unsubscribe link in promotional emails we send you.

* If we have collected and processed your personal data with your consent, you may withdraw your consent at any time. Withdrawal of your consent will not affect the lawfulness of any processing we have carried out prior to your withdrawal, nor the processing of your personal information carried out on the basis of lawful processing grounds other than consent.

* You have the right to complain to a data protection authority about our collection and use of your personal information. For more information, please contact the Commission Nationale de l'Informatique et des Libertés (CNIL). We are committed to responding to all your requests concerning your data protection rights in accordance with applicable laws.

Updates to this privacy policy

Please note that this privacy policy may be amended or supplemented at any time, in particular to comply with any changes in legislation, regulations, case law or technology. In such a case, the date of its update will be clearly identified at the top of this policy and we will take appropriate measures to inform you, in accordance with the importance of the changes we make. We will obtain your consent to any significant privacy policy changes if and to the extent required by applicable data protection laws.
